Terms & Conditions

These Terms and Conditions ("Terms") govern your use of Nestward's website (the "Site") and the document coordination services we provide ("Services"). By using the Site or engaging our Services, you agree to these Terms. If you do not agree, please do not use the Site or engage our Services.

1. Definitions
- "Nestward", "we", "us", "our" — the document coordination business operating from 12 Jalan Gaya, 88000 Kota Kinabalu, Sabah, Malaysia.
- "Client", "you", "your" — any individual or household that engages our Services or uses the Site.
- "Services" — administrative document coordination, records organisation, scanning, labelling, summarising and related non-regulated activities as described on the Site and in engagement letters.
- "Engagement" — a specific programme (Starter Sort, Household Records Programme, or Two-Generation Archive Programme) agreed in a written engagement letter.
- "Agreement" — the written engagement letter together with these Terms and our Privacy Policy.
2. Acceptance of terms
By submitting an enquiry form on the Site, or by signing an engagement letter, you confirm that you are at least 18 years of age and have the legal capacity to enter into an agreement. If you are arranging an engagement on behalf of another person (e.g. an elderly parent), you confirm that you have authority to do so.
3. Nature of services
Nestward provides administrative coordination and general information organisation services only. Our work includes sorting, labelling, scanning, indexing, summarising and writing orientation documents.
Our Services do not include and should not be understood to include:
- Legal advice of any kind
- Financial advice, including advice on pension entitlements, EPF withdrawals or investment matters
- Interpretation of regulated documents
- Representation or communication with government bodies, employers or financial institutions on your behalf
- Assessment of any entitlement or claim
Where questions of a regulated nature arise during our work, we collect them in a written register and refer you to seek professional advice. We do not answer such questions speculatively. Nothing we say or write during a session constitutes professional advice of any kind.
4. Service availability
Our Services are available to households in Kota Kinabalu and the surrounding areas of Sabah, Malaysia. Sessions outside Kota Kinabalu are available subject to prior arrangement. We do not currently offer remote or video-based coordination sessions.
5. Engagement process
Each engagement begins with an enquiry, followed by a brief initial conversation (by telephone or email) and, if agreed, the issue of a written engagement letter. No session takes place until both parties have agreed to the engagement letter in writing.
The engagement letter sets out the programme scope, number of sessions, fee, deliverables and any specific arrangements for the household. These Terms apply in addition to the engagement letter; where the engagement letter is more specific, it prevails.
6. Fees and payment
Fees for each programme are as stated on the Site at the time of engagement and confirmed in the engagement letter. Fees cover all coordinator time and written outputs described in the programme scope. Physical materials (folders, box files) are supplied at cost if requested.
- Payment is due within 14 days of the invoice date
- Payment may be made by bank transfer to details provided in the engagement letter
- Accepted currency: Malaysian Ringgit (MYR)
- If an engagement closes early at the client's request, the fee is prorated to sessions completed; no minimum charge applies
- If an engagement closes early due to a breach of these Terms by the client, the full engagement fee is due
7. Client responsibilities
You agree to:
- Provide accurate information during the initial conversation and throughout the engagement
- Be present during sessions, or arrange for a representative with authority over the documents to be present
- Notify us at least 48 hours in advance if a session needs to be rescheduled
- Not ask us to interpret regulated documents, assess entitlements or contact institutions on your behalf
- Retain the written outputs (summaries, gap lists, document maps) and use them as you see fit, understanding that we have no ongoing responsibility for their contents after delivery
8. Document handling
All original documents remain in your possession at all times during sessions. We do not remove originals from your home or office. Digital copies produced during the engagement are saved to storage you own and control. Working copies held on our equipment are deleted within seven days of engagement completion.
9. Intellectual property
Written outputs produced by Nestward (summaries, gap lists, document maps, orientation notes, registers) are provided to you for personal household use. You may share them within your household and with professional advisers. You may not reproduce or distribute them commercially.
All content on the Site (text, structure, templates) belongs to Nestward. You may not copy, reproduce or distribute Site content without our prior written consent.
10. Disclaimers
Our Services are provided on an "as available" basis. While we take care in our work, we do not warrant that written outputs are complete, error-free or suitable for any particular purpose beyond the household context in which they were created.
We are not responsible for any loss or consequence arising from reliance on our written outputs without independent professional verification of regulated matters.
The Site is provided without warranty. We do not guarantee uninterrupted access or that the Site is free of errors.
11. Limitation of liability
To the extent permitted by Malaysian law, Nestward's total liability to you for any claim arising from an engagement shall not exceed the fee paid for that engagement. We exclude liability for indirect, consequential or special losses.
Nothing in these Terms limits liability for fraud, death or personal injury caused by our negligence.
12. Cancellation and termination
Either party may close an engagement early by giving written notice. If you close an engagement early, the fee is prorated as described in section 6. If we close an engagement early, we will refund the portion of the fee corresponding to sessions not yet completed.
We may decline to continue an engagement if you request us to perform work outside our stated scope and decline to accept an explanation of why we cannot do so.
13. Governing law and disputes
These Terms are governed by the laws of Malaysia. Any dispute arising from these Terms or an engagement shall first be referred to informal resolution by written notice to the other party. If unresolved within 30 days, the dispute shall be referred to the courts of Sabah, Malaysia.
14. Changes to these terms
We may update these Terms from time to time. The current version is always available on the Site. Where changes are material, we will post a notice on the Site. Continued use of the Site or engagement of our Services after a revision constitutes acceptance of the updated Terms.
